1. Using Tsukimi
Tsukimi is provided by Yumi Nexus (Wenxi Jiao), Auckland, New Zealand. These terms concern the Tsukimi sharing service and website. The App Store app license is governed by Apple's Standard End User License Agreement unless a separate license is provided with the app. These terms do not replace Apple's terms for iCloud or your Apple Account.
You must be able to agree to these terms under applicable law, with a parent or guardian's involvement where required. Use your own authorized Apple Account and devices. A separate Tsukimi account is not required.
Pre-release status: Tsukimi is currently in development. Test builds can contain defects and are not suitable for important or time-sensitive communication. Publishing this website does not mean the app has been released.
2. Your drawings, photos and notes
You retain your rights in content you create. Only send material you own or have permission to use, including permission where needed from people shown in a photo. You permit the app and its delivery providers to store, process and transmit your content as necessary to provide the sharing features you choose. This is not permission to sell your drawings or use them in advertising.
Creating does not broadcast your work. Sharing happens when you confirm Send and transmits the finished image. The other person may save, export or capture it. Do not send anything you would be uncomfortable with them keeping.
3. Respectful sharing
Tsukimi is a private space, not a public feed. Do not use it for unlawful content, harassment, threats, impersonation, exploitation, non-consensual intimate material, copyright infringement or attempts to gain unauthorized access. Do not forward a private invitation to someone the sender did not intend to invite.
If a connection feels unsafe, disconnect in Connect or Settings. You can report a Tsukimi problem, abuse concern or rights complaint to support@yumi.nexus. Include only the information needed to understand the issue. We do not promise that private content is proactively monitored or that an email report can recall another person's saved copies. For immediate danger, contact appropriate local emergency services.
4. Pairing and disconnecting
A pairing is for two people only. You must disconnect the existing pairing before connecting with someone else. On supported systems, a single-use invitation can be claimed by the first account that accepts it, so share the link only with your intended person. An invitation can be opened later; both people do not need to keep the app open at the same time.
Either person can disconnect. The owner ends the CloudKit share; an invited person leaves their shared access. Network confirmation is required. Your local drawings and exported pictures remain, but shared access and this device's frame cache change. Content already saved by the other person cannot be recalled. Details are in the Privacy Policy.
An older multi-person test connection must be disconnected before starting a new two-person pairing. We will not automatically choose which former member to retain or erase your local drawings.
5. Availability, devices and backups
CloudKit sharing requires a usable iCloud account, internet access and supported Apple devices. Apple manages account restrictions, storage and platform availability. Background delivery and Home Screen widget refresh are controlled by iOS and iPadOS; an immediate update is not guaranteed. You must add widgets yourself through the system widget gallery.
Keep separate copies of pictures that matter to you. Deleting the app, changing an account or device, losing access to a share or a software defect can affect availability. Features and supported versions may change. If a significant change affects the service, we will communicate it as required by applicable law.
6. Privacy and your legal rights
The Privacy Policy explains information handling, providers and your choices. Please review it before sharing personal content.
Nothing in these terms excludes or limits rights or remedies that cannot lawfully be excluded, including applicable rights under New Zealand's Consumer Guarantees Act 1993 and Fair Trading Act 1986. Apple is not responsible for operating the Tsukimi sharing service; app licensing and Apple's own services remain subject to Apple's applicable terms.
New Zealand law applies to these service terms without depriving you of mandatory protections or jurisdiction rights that apply where you live. These terms may be updated with an amended effective date and any notice required by law.
